1. Settings
“The Company/We” – Everest Import Machinery Ltd.
“User/Customer” – anyone who enters the site and/or performs an action on it.
“Products” – equipment/machinery, spare parts, accessories and related services displayed on the site.
“Distance sales transaction” – a transaction carried out by means of communication without the physical presence of the parties.
2. Competence and proper use
2.1 The site is intended for use by persons 18 years of age and older. Making a purchase by a minor requires the approval of a guardian.
2.2 The user undertakes not to use the site in a prohibited, offensive, misleading, infringing manner, or in a manner that may disrupt the site's operations.
2.3 The Company may block access/cancel an order in any case of violation or suspected violation of the law or the regulations.
3. Website information and product images
3.1 Information and images are presented for illustrative purposes only; there may be differences between the images and specifications and the actual product.
3.2 Performance data, work capacity, outputs, power consumption, etc. may vary between models/series/configurations.
3.3 The responsibility for verifying the suitability of the product for its intended purpose and specific needs lies with the customer; it is recommended to consult with a qualified professional/technician before purchase and installation.
4. Prices, payments and taxes
4.1 Prices on the site include VAT unless otherwise stated. The Company may update prices from time to time without prior notice.
4.2 Payment will be made using the payment methods available on the site or as agreed in writing with the company.
4.3 In the event of a typographical/display/incorrect pricing error, the Company will be entitled to cancel the order and refund the customer any money actually paid.
5. Orders, stock availability and delivery
5.1 An order on the Site constitutes an offer to purchase; the transaction is complete only after final approval by the Company.
5.2 Delivery is subject to stock availability, payment security approvals and logistical coordination.
5.3 Delivery of heavy/sensitive products may require special unloading conditions (truck access, crane, service elevator, coordination of reception hours). Responsibility for preparing the customer's site lies with the customer.
5.4 Delivery times and shipping/unloading costs will be detailed in the shipping policy and on the order page.
6. Installation, operation and safety
6.1 Certain products require installation/calibration/operation by a qualified technician only. Failure to comply with this instruction may void the manufacturer/importer's warranty and pose a safety hazard.
6.2 The customer undertakes to act in accordance with the manufacturer's instructions and applicable safety laws, and to prepare the work environment in accordance with occupational safety and health laws.
6.3 The Company will not be liable for damage caused by improper use, improper maintenance, unauthorized changes, or operation under conditions that are not in accordance with the instructions.
7. Returns, cancellations and consumer rights (*)
7.1 A consumer customer (who is not a “dealer”) has cancellation rights under the law in distance selling transactions, including the option of cancellation within 14 days and a refund in accordance with the provisions of the law. Cancellation fees – up to 5% of the transaction price or 100 NIS, whichever is lower ().
7.2 In a distance selling transaction with a person with a disability/senior citizen/new immigrant – there is a right to cancel within 4 months, subject to law ().
7.3 There are exceptions to the law regarding certain products (e.g., custom-made products, products damaged due to unreasonable use, etc.). Updated details appear in the Shipping and Returns Policy.
7.4 Without derogating from consumer rights under law – the Company may offer a favorable returns policy; in the event of a conflict – the legal provision will prevail.
8. Warranty, Service and Repairs
8.1 Warranty (if any) will be provided according to the manufacturer's/importer's terms only and subject to presentation of an invoice and compliance with terms of use/maintenance.
8.2 Repair and maintenance services will be provided according to updated rates/agreements. Transportation/dismantling/installation – at the expense of the customer unless otherwise specified in writing.
9. Limited Liability and Limitation of Damages
9.1 To the maximum extent permitted by law, the Company will not be liable for any indirect, special, consequential damages, loss of profit/data/reputation, or any delay resulting from force majeure, external fault, or act/omission of a third party.
9.2 The foregoing does not detract from liability that cannot be conditioned under any law.
10. Intellectual Property
10.1 All intellectual property rights on the site – including texts, designs, trademarks, images, video, code and content – are reserved by the company and/or the rights holders.
10.2 No use of content may be made without prior written permission.
11. User Content and Feedback
11.1 Content/reviews posted by users are the sole responsibility of the advertiser. The Company may remove offensive/infringing content.
11.2 Submitting an idea/feedback will be considered consent to a non-renewable, worldwide, royalty-free license.
12. Third-party links and services
The Site may include links to third-party services/sites. The Company is not responsible for the content, policies, or information security practices of these parties.
13. Privacy and Spam (*)
13.1 Use of the website is subject to the company's privacy policy, which includes, among other things, the right to review and correct details in accordance with the law ().
13.2 Sending “advertising material” will only be done subject to consent as required, will include identifying information and a clear removal method, and in accordance with the provisions of applicable law ().
14. Information security
The Company implements reasonable measures to protect the information. However, there is no absolute security, and the User declares that he is aware of the risks existing on the Internet and takes appropriate precautions.
15. Changes to the transaction and service
The company may change the product offering, specifications, website content, rates and terms of the regulations at any time. Changes to the regulations will apply from the date of their publication on the website. Orders that were approved before the change – will remain valid according to the terms that preceded the change, subject to law.
16. Force Majeure
Force majeure events, strikes, shutdowns, network/supplier failures, epidemics, wars, fires, floods, supplier delays or events beyond the control of the company – will postpone deadlines and exempt from liability as long as the event continues.
17. Law and jurisdiction
The regulations will be governed solely by the laws of the State of Israel. Exclusive jurisdiction – the competent courts in the Haifa district.
